Win A OneTeaspoon Festival Outfit Competition

1. General

(a) Pink Factory Pty Ltd, trading as OneTeaspoon, 8 Powells Road, Brookvale, NSW, 2100, oneteaspoon.com.au is the “Sponsor”.

(b) Information on how to enter forms part of these Terms and Conditions.

(c) By entering the Win A OneTeaspoon Festival Outfit Competition (the “Promotion”), promoted by OneTeaspoon you agree to these Terms and Conditions and any other applicable terms as advised by OneTeaspoon.

(d) For the purposes of these Terms and Conditions, OneTeaspoon includes its parent companies, related and subsidiary companies, past present and future officers, agents, representatives, and employees.

 

2. Entry requirements

(a) Eligibility: To enter the Win A OneTeaspoon Festival Outfit Competition (the “Promotion”), entrants must be residents of Australia or the United States and aged 18 years or older. The agents, contractors, employees and family members (defined as parents, children, siblings and spouse and their respective spouses, regardless of where they reside) of OneTeaspoon and those living in the same household are not eligible to enter the competition. Void in all U.S. territories and possessions and overseas military installations and where prohibited or restricted by law.

(b) How To Enter: A valid public Instagram account and internet access are required to enter this Promotion. To enter you must follow OneTeaspoon's official Instagram channel at www.instagram.com/oneteaspoon_. For the avoidance of doubt, the entrant must be following @oneteaspoon_ on Instagram at the time of judging. During the Promotion Period, @oneteaspoon_ will post a photo to Instagram that features OneTeaspoon products and announces this Promotion (each a "Promotion Post"). Like and comment on the Promotion Post by tagging your best friends and telling OneTeaspoon (the "Sponsor") your music festival plans through an emoji story (individually "Entry", collectively "Entries"). To be valid, entries must be received no later than July 16th, 2018 at 11:59PM (AEST).

OneTeaspoon reserves the right to verify the validity of entries and entrants (including an entrant’s identity, age and address) and to disqualify any entrant who submits an entry that is not in accordance with these conditions of entry. Incomplete or illegible entries will be deemed invalid. Any incorrect entrant details submitted may render the corresponding entry invalid. It is each entrant’s responsibility to inform OneTeaspoon if their personal details change prior to the Winner Notification Date.

(b) How to Enter: A valid public Instagram account and internet access are required to enter this Promotion. To enter you must, follow OneTeaspoon’s official Instagram channel at www.instagram.com/oneteaspoon_. For the avoidance of doubt, the entrant must be following @oneteaspoon_ on Instagram at the time of judging. During the Promotion Period, @oneteaspoon_  will post a photo to Instagram that features OneTeaspoon products and announces this Promotion (each a “Promotion Post”). Like and comment on the Promotion Post by tagging your best friends and telling OneTeaspoon (the “Sponsor”) your music festival plans through an emoji story (individually “Entry”, collectively “Entries”). 
To be valid, Entries must be received no later than July 15th, 2018 at 11:59 PM (AEST).

(c) Entry Conditions: The authorised account holder of the email address used to enter the Promotion is deemed to be the entrant. The “authorised account holder” is the natural person assigned to an email address by an internet access provider, online service provider or other organisation responsible for assigning email addresses for the domain associated with the submitted address. Each potential winner may be required to show proof of being the authorised account holder.

(d) Winner Selection and Judging: There will be one (1) winner during the promotional period.  The best emoji story as determined by the judges will be deemed as the winner on or about July 17th, 2018. This is a game of skill and chance plays no part in determining the winner. Each entry will be individually judged based on creativity, and relevance to the theme. Entries will be judged at the OneTeaspoon Head Office at 8 Powells Road, Brookvale, NSW, 2100. 

Potential winning entrants will be contacted via Instagram direct message. If a potential winning entrant is determined by the Sponsor to be unqualified to participate in this Promotion or does not respond to the Sponsor’s correspondence within 24 hours, the potential winning entrant will be disqualified and a new potential winning entrant will be selected based on merit. OneTeaspoon will not be liable to any prize winner who cannot be contacted at the details provided. The decision of the judges is final and will not enter into correspondence or communication regarding the judges’ decisions.

(e) Required Documentation: The winner will be requested to provide full contact details: full name and email address. If the winner fails to provide the full information in the manner requested they will not be eligible for the competition prize.

(f) Promotional Period: Entries to this competition open on Friday 13th July, 2018 at 12.01pm (AEST) and will close Monday 16th July, 2018 at 11.59pm (AEST). The winner will be announced on or about Tuesday, 17th July 2018.

(g) Publicity: The winner of this competition agrees that their identity including the entrants name and/or Instagram account, may be disclosed in winner announcements and promotional material, without further payment or compensation.

 

3. Exclusion of Liability

(a) If this Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Sponsor, the Sponsor reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

(b) Any cost associated with accessing Instagram and mobile applications is the Entrant’s responsibility.  The Sponsor is not responsible for technical, hardware or software failures, malfunctions, lost or unavailable network connections or failed, incomplete, garbled or delayed computer transmissions or unforeseen schedule changes that may limit an entrant’s ability to participate in the Promotion, even if caused by Sponsor’s negligence. Entries generated by script, macro or other automated means or with the intent to impair the integrity of the Promotion will be void. Sponsor has the sole discretion to modify, cancel or suspend this Promotion should viruses, bugs, unauthorized human intervention or other causes beyond Sponsor’s control affect the administration, security or proper play of the Promotion or Sponsor otherwise becomes incapable of running the Promotion as planned. Sponsor is not responsible for changes to entrant’s contact information. Any individual who attempts or otherwise encourages, directly or indirectly, the submission of false entries, as determined by Sponsor, will be disqualified. Sponsor has the sole discretion to disqualify any entrant who tampers with the entry process. Sponsor has the sole discretion to disqualify entrants who violate these Official Rules, tamper with the operation of the Promotion or engage in any conduct that is deemed detrimental or unfair to Sponsor, the Promotion or any other entrant. Sponsor has no obligation to return any entry consideration, if applicable, submitted by a disqualified entrant. 

(c) Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the competition, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any claim or offer that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in gift value to that stated in these Terms and Conditions; (e) any tax liability incurred by a entrant; or (f) use of a Prize.

 

4. Prizes

(a) The prize cannot be used in conjunction with any other offer.

(b) OneTeaspoon will not be liable for any loss or damage whatsoever which is suffered (including but not limited to direct or consequential loss) or for personal injury suffered or sustained, as a result of taking any prize under this competition.

(c) If a prize referred to in this competition becomes unavailable for any reason OneTeaspoon reserves the right to substitute that prize for a similar item of similar value.

(d) Prizes are not transferable or redeemable for cash. OneTeaspoon accepts no responsibility for any variation in the value of the prizes.

(e) The one (1) winner of the competition will receive an AUD $1000 OneTeaspoon voucher to spend on online at OneTeaspoon www.oneteaspoon.com 
(f) Taxes on prize, if any, are solely the responsibility of the winner. 

 

6. Intellectual Property

(a) OneTeaspoon may publish, adapt, communicate or otherwise use the entrant's winning submission and/or prize winner's names for advertising and publicity purposes in any media in perpetuity without needing to provide additional compensation.

 

7. Warranties

(a) Entrants warrant and represent to OneTeaspoon that nothing in any entry to any competition infringes the rights, including copyright, of any third party and is not defamatory or obscene and does not breach any state or commonwealth law.

(b) If OneTeaspoon becomes aware that a prize winner is in breach of any warranty contained in these Terms and Conditions, OneTeaspoon may deem that prize winner ineligible.

 

8. Governing Law

(a) These Terms and Conditions are to be construed according to the competition laws of Western Australia, Northern Territory, South Australia, Queensland, New South Wales, Victoria, and Tasmania Australia and are subject to the non-exclusive jurisdiction of the courts of each state and territory.
